Introduction
Konnector hereinafter referred to as the "Company" (where such expression shall, unless repugnant to the context thereof, be deemed to include its respective legal heirs, representatives, administrators, permitted successors and assigns). The Company ensures steady commitment to your usage of the Platform and privacy with regard to the protection of your invaluable information. This document contains information about the Website "Konnector" hereinafter referred to as the "Platform".
For the purpose of these Terms of Use ("Terms"), wherever the context so requires:
- "We", "Our", and "Us" shall mean and refer to the Domain and/or the Company, as the context so requires.
- "You", "Your", "Yourself", "User" shall mean and refer to natural and legal individuals who use the Platform and who is competent to enter into binding contracts, as per the laws of United States of America.
- "Services" shall refer to offerings provided by the Company.
- "Third Parties" refer to any Application, Company or individual apart from the User, and the creator of this Platform. It shall include such payment gateways as partnered by the Company.
- "Platform" refers to the Website/Domain created by the Company which provides the Client to avail services of the Company through the use of the platform.
The use of this Platform by the Users is solely governed by these Terms as well as the Privacy Policy and other policies as listed on the Platform, and any modifications or amendments made thereto by the Company, from time to time, at its sole discretion.
Registration
Registration is mandatory to use the Services of the platform. If the User fails to register on the Platform, they will be unable to avail the Services on the Platform.
- The Users are provided with an option to link their Facebook accounts, Google Account, Twitter account and Apple ID with the Platform at the time of their registration.
- Registration for this Platform is available only to those above the age of Eighteen (18) years, barring those "Incompetent to Contract".
- The Registration and use of the Platform are chargeable and the same can be amended at any time at the sole discretion of the Company.
- You are solely responsible for protecting the confidentiality of Your Username and password, and any activity under the account shall be deemed to have been done by You.
Platform Overview
The Platform aims at improving efficiency of inbound leads converting to meetings, thereby enhancing the chances of the prospect converting into a customer for our clients.
Eligibility
The Users further represents that they will comply with this Agreement and all applicable local, state, national and international laws, rules and regulations. The Users may not use the Platform if they are not competent to contract or are disqualified from doing so by any other applicable law, rule or regulation currently in force.
Subscription
- You'll see the total price before completing payment.
- Konnector subscriptions purchased automatically renew upon the completion of the subscription period.
- To avoid renewal, you must turn off auto-renew at least 24 hours before your subscription ends.
- You can turn off auto-renew at any time from your iTunes account, Android or credit/debit card settings.
- Any unused portion of a free trial, if we're currently offering one, will be forfeited should you purchase a subscription.
- The plans available for the user are subject to change at the sole discretion of the company.
- The user is allowed to subscribe to a plan, change a subscription plan or cancel a subscribed plan.
- The subscription plan can only be modified or canceled via the platform from where it was originally bought.
- If any charges are not received from you on or before the due date, then late charges with interest at the rate of 2.5% of the outstanding balance per month may apply.
- Any change in the subscription plan (upgrade, downgrade or cancellation) would be applied after the current plan duration has finished.
- The subscription plan is applied to a login ID. Once purchased via any platform, the user can enjoy the benefits on all platforms by logging in with the login id.
- At a given point of time, only 1 login will work on 1 device.
Refund Policy
The User cannot seek a refund of any payment made on the Platform at any time after the payment has been processed by the Platform as a right. The Company processes a claim for refund solely at their discretion.
Content
- All text, graphics, User interfaces, visual interfaces, photographs, trademarks, logos, brand names, descriptions, sounds, music and artwork (collectively, 'Content'), is generated/provided by Platform and the Platform have control over it.
- All the Content displayed on the Platform is subject to copyright and shall not be reused by any party (or a third party) without the prior written consent of the Company and the copyright owner.
- The Platform may capture data from its third-party Vendors, which would be used for enhancing the services delivered.
- The Users are solely responsible for the integrity, authenticity, quality and genuineness of the feedback and comments.
- The Users have a personal, non-exclusive, non-transferable, revocable, limited privilege to access the Content on the Platform.
Term
- These Terms shall continue to form a valid and binding contract between the Parties and shall continue to be in full force and effect until the User continues to access and use the Platforms.
- The Users may terminate their use of the Platform at any time.
- The Company may terminate these Terms and close a User's account at any time without notice and/or suspend or terminate a User's access to the Platform at any time and for any reason.
- Such suspension or termination shall not limit our right to take any other action against you that the Company considers appropriate.
- It is also hereby declared that the Company may discontinue the Services and Platforms without any prior notice.
Termination
- The Company reserves the right, in its sole discretion, to unilaterally terminate the User's access to the Platform, or any portion thereof, at any time, without notice or cause.
- The Platform also reserves the universal right to deny access to particular Users without any prior notice/explanation in order to protect the interests of the Platform.
- The Platform reserves the right to limit, deny or create different access to the Platform and its features with respect to different Users, or to change any of the features or introduce new features without prior notice.
- The User shall continue to be bound by these Terms, and it is expressly agreed to by the Parties that the User shall not have the right to terminate these Terms till the expiry of the same.
Communication
By using this Platform and providing his/her identity and contact information to the Company through the Platform, the Users hereby agree and consent to receive calls, e-mails or SMS from the Company and/or any of its representatives at any time.
Clients can report to varun@konnector.ai if they find any discrepancy with regard to Platform or content-related information and the Company will take necessary action after an investigation.
Charges
- The Customer shall pay an amount for the services availed through the Platform directly to the Company in any of the prescribed modes of Payment Methods – Credit/Debit, Internet Banking, prescribed payment gateways.
- The Charges for all the subscription are subject to change at the sole discretion of the company.
- Additional processing charge would be levied on the payments made based on the current payment gateway fees.
- The payment is processed through a third-party gateway (currently Stripe) and the User shall be bound by the third party's terms and conditions.
- The User cannot seek a refund of any payment made on the Platform at any time after the payment has been processed by the Platform as a right.
- The Company will not be liable for any credit or debit card fraud.
- The Company reserves the right to cancel all past, pending and future orders and block the concerned User account in case of detecting any suspicious activity.
User Obligations and Formal Undertakings as to Conduct
The Client agrees and acknowledges that they are a restricted user of this Platform and that they:
- Agree to provide genuine credentials during the process of registration on the Platform.
- Agree to ensure the Name, Email address, Address, Mobile number, date of Birth, Gender and any such other information provided during account registration is valid at all times.
- Agree that they are solely responsible for maintaining the confidentiality of your account password.
- Authorize the Platform to use, store or otherwise process certain personal information for personalization of Services, marketing and promotional purposes.
- Are bound not to cut, copy, modify, recreate, reverse engineer, distribute, disseminate, post, publish or create derivative works from any information or content obtained from the Platform.
- Agree not to access (or attempt to access) the Platform by any means other than through the interface provided by the Platform.
Suspension of User Access and Activity
The Company may in its sole discretion, limit the User's access and/or activity by immediately removing the User's access credentials either temporarily or indefinitely, or suspend/terminate the User's association with the Platform:
- If the User is in breach any of these Terms or the Policy.
- If the User has provided wrong, inaccurate, incomplete or incorrect information.
- If the User's actions may cause any harm, damage or loss to the other Users or to the Company.
Indemnity
The Users of this Platform agree to indemnify, defend and hold harmless the Company/Platform, and their respective directors, officers, employees and agents from and against any and all losses, liabilities, claims, damages, demands, costs and expenses asserted against or incurred by us that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed pursuant to these terms of use.
Limitation of Liability
The Founders/Promoters/Partners/Associated people of the Company/Platform are not responsible for any consequences arising out of the following events:
- If the Platform is inoperative/non-responsive due to any connectivity errors associated with the internet connection.
- If the User has fed incorrect information or data or for any deletion of data.
- If there is an undue delay or inability to communicate through email.
- If there is any deficiency or defect in the Services managed by Us.
- If there is a failure in the functioning of any other service provided by the Platform.
The Platform accepts no liability for any errors or omissions, on behalf of itself, or for any damage caused to the User, the User's belongings, or to any third party, resulting from the use or misuse of the Platform or any service availed of by the User through the Platform.
Intellectual Property Rights
Unless expressly agreed to in writing, nothing contained herein shall give the User a right to use any of the Platform's trademarks, service marks, logos, domain names, information, questions, answers, solutions, reports and other distinctive brand features. All logos, trademarks, brand names, service marks, domain names, including material, designs, and graphics created by and developed by the Platform are the property of the Company or the respective copyright or trademark owner.
Force Majeure
Neither the Company nor the Platform shall be liable for damages for any delay or failure to perform its obligations hereunder if such delay or failure is due to cause beyond its control or without its fault or negligence, due to Force Majeure events including but not limited to acts of war, acts of God, earthquake, riot, fire, festive activities sabotage, labour shortage or dispute, internet interruption, technical failure, breakage of sea cable, hacking, piracy, cheating, illegal or unauthorized.
Dispute Resolution and Jurisdiction
It is expressly agreed to by the Parties that the formation, interpretation and performance of these Terms and any disputes arising therefrom will be resolved through a two-step Alternate Dispute Resolution ("ADR") mechanism:
- Mediation: In case of any dispute between the parties, the Parties will attempt to resolve the same amicably amongst themselves, to the mutual satisfaction of all Parties. In the event that the Parties are unable to reach such an amicable solution within thirty (30) days of one Party communicating the existence of a dispute to any other Party, the dispute will be resolved by arbitration.
- Arbitration: In the event that the Parties are unable to amicably resolve a dispute by mediation, said dispute will be referred to arbitration by a sole arbitrator to be appointed by the Company, and the award passed by such sole arbitrator will be valid and binding on all Parties. The arbitration shall be conducted in English, and the seat of Arbitration shall be at Delaware Chancery Court.
The Parties expressly agree that the Terms of Use, Privacy Policy and any other agreements entered into between the Parties are governed by the laws, rules and regulations of the United States of America.

Any and all communication relating to any dispute or grievance experienced by the User may be communicated to the Company by the User by emailing to varun@konnector.ai
Miscellaneous Provisions
- Entire Agreement: These Terms, read with the Policy, form the complete and final contract between the User and the Company with respect to the subject matter hereof and supersedes all other communications, representations and agreements (whether oral, written or otherwise) relating thereto.
- Waiver: The failure of either Party at any time to require performance of any provision of these Terms shall in no manner affect such Party's right at a later time to enforce the same.
- Severability: If any provision/clause of these Terms is held to be invalid, illegal or unenforceable by any court or authority of competent jurisdiction, the validity, legality and enforceability of the remaining provisions/clauses of these Terms shall in no way be affected or impaired thereby.
